CMC statement regarding Palm Island death in custody
The Crime and Misconduct Commission has been fully briefed by the Director of Public Prosecutions (DPP) about the reasons behind her decision not to proceed with charges against police officer Chris Hurley, following the death in custody of an Aboriginal man on Palm Island. The CMC has carefully considered the DPP’s conclusions and the evidence that would be admissible in any disciplinary proceedings. The Commission has determined that the evidence would not be capable of proving before any disciplinary tribunal that Senior Sergeant Hurley was responsible for Mulrunji’s death. Therefore, the Commission has reached the inevitable conclusion that no disciplinary action before the Misconduct Tribunal or by the Queensland Police Service (QPS) can be taken against the police officer in relation to the cause of death or in relation to the charges of assault or perjury mentioned in the DPP’s media statement today. Any other disciplinary charges against Senior Sergeant Hurley arising from the Coronial Inquest are now the responsibility of the QPS.
